1. Acceptance of Terms

By accessing and using Buzzega™ ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

2. Description of Service

Buzzega™ is a real-time interactive quiz and buzzer-based game platform designed for live hosting, classrooms, competitions, and events. The Platform provides tools for creating, hosting, and participating in interactive quiz games.

3. User Accounts, Eligibility and Age

Only a Host needs an account. Players join a game with a game PIN and a display name, and never create an account.

3.1 Minimum age to host — 13. You must be at least 13 years old to create a Buzzega™ Host account. Thirteen is the age at which a child can consent to their own data being processed by an online service in the United Kingdom under the UK GDPR and the Data Protection Act 2018. Below that age we cannot rely on your consent, and we do not operate a verified parental-consent process, so we do not permit an account. You can still take part as a Player in someone else’s game, which needs no account and no email address.

3.2 Minimum age to purchase — 18. Hosting is free from age 13. Buying any paid plan requires you to be at least 18, confirmed separately before payment. A subscription is a contract, and a contract with a minor is generally unenforceable; our payment providers also require the account holder to be an adult. If you are 13 to 17, ask a parent or guardian to purchase using their own account.

3.3 If you are 13 to 17. You may create an account and host on the Free plan. We encourage you to tell a parent, guardian or teacher, particularly if children will play your games. You remain responsible for the content you publish, and the Acceptable Use Policy and Community Guidelines apply to you in full.

3.4 Age is self-declared. We ask for a confirmation, not a date of birth or proof of identity. Collecting a date of birth would mean holding a stronger identifier than anything else we keep about you, which for a service used by children runs against the data-minimisation principle in Article 5(1)(c) UK GDPR and the Information Commissioner’s Age Appropriate Design Code. We rely on your confirmation being honest and may suspend an account we believe breaches this section.

For all accounts, you agree to:

• Provide accurate, current, and complete information during registration
• Confirm truthfully that you meet the minimum age in 3.1, and in 3.2 before purchasing
• Maintain the security of your password and account
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorised use of your account

4. Subscription Plans

Buzzega™ operates on a freemium model with the following tiers:

• Free Plan: Up to 5 players per game, unlimited games
• Starter Plan: Up to 25 players per game, advanced features
• Pro Plan: Up to 100 players per game, premium features
• Enterprise Plan: Unlimited players, custom branding, priority support

All prices are shown in British Pounds (GBP) and include VAT where applicable.

5. Payment Terms and VAT

You must be 18 or over to purchase a paid plan. Hosting is free from age 13, but a subscription is a contract and our payment providers require the account holder to be an adult (section 3.2). We ask you to confirm this before checkout and record your confirmation. Payments are processed by third-party payment providers; we do not receive or store your full card details. If we learn a paid plan was purchased by someone under 18, we may cancel the subscription and will refund any amount charged after the date we became aware.

For paid subscriptions, you agree to pay all fees according to the billing terms in effect at the time. VAT will be charged in accordance with UK tax regulations. We reserve the right to change our pricing structure with 30 days' notice. Refunds will be processed in accordance with UK consumer protection laws.

6. Acceptable Use Policy

You agree not to use the Platform to:

• Create or share content that is illegal, harmful, or offensive under UK law
• Violate any applicable UK laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorised access to the Platform or other users' accounts
• Use the Platform for any commercial purpose without our prior written consent
• Engage in any automated or systematic data collection without permission

7. Intellectual Property

All content, features, and functionality of the Platform are owned by Buzzega™ and are protected by UK and international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by UK law, Buzzega™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform. Our total liability shall not exceed the amount paid by you for the service in the twelve months preceding the claim.

Nothing in these terms shall limit or exclude our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under UK law.

9. Termination

We reserve the right to terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or the Platform, subject to your statutory rights.

10. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Data Protection

We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal data.

12. Consumer Rights

If you are a consumer, you have certain statutory rights under UK consumer protection law. Nothing in these Terms of Service affects those statutory rights.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes via email or through the Platform. Your continued use of the Platform after such modifications constitutes acceptance of the updated terms.
